Terms & Conditions for KO Construction

These Terms and Conditions (“Terms”) govern your use of the website koconstruction.co.in (the “Website”) and your engagement with KO Construction (“the Company,” “we,” “us,” or “our”) for any construction, architecture, or interior design services (the “Services”). 2. General Service Engagement Terms
A. Contractual Agreement
All Services provided by KO Construction, including architectural design, plan approval, construction, and renovation, shall be governed exclusively by a separate, detailed Written Construction Agreement or Service Contract signed by both the Client and the Company. These Terms serve as the general framework and are subordinate to the specific, signed Contract.
B. Quotations and Estimates
Any cost estimates or quotations provided by KO Construction are provisional and subject to change based on:
Finalized architectural plans and material specifications.
Fluctuations in market prices for labor, materials (steel, cement, aggregates, etc.), and regulatory charges.
Unforeseen site conditions discovered during excavation or construction.
C. Plan Approval Responsibility
When the service includes Plan Approval, the Company will prepare and submit the necessary documents to the local governing bodies (e.g., local municipality or planning authority). The final approval timeline is dependent on the governmental authority, and the Company is not liable for delays caused by the approval process.
D. Payment Terms
All payments shall be made according to the schedule and amounts stipulated in the signed Construction Agreement, typically tied to the completion and verification of specific project milestones. Failure to make scheduled payments on time may result in the suspension of work until payment is received, and the project timeline will be adjusted accordingly.
3. Project Execution and Quality
A. Materials and Workmanship
KO Construction guarantees that all work will be performed in a professional manner and in accordance with industry standards, using the quality and brand of materials specified in the final, signed Contract.
B. Project Duration and Delays
We will endeavor to complete the project within the estimated duration outlined in the Contract. However, we shall not be liable for delays caused by:
Force majeure events (e.g., natural disasters, extreme weather).
Changes requested by the Client after construction begins.
Governmental delays, including plan approval or utility hook-up.
Strikes, material shortages, or supplier issues beyond our reasonable control.
C. Site Access and Client Responsibility
The Client must ensure the site is clear, properly demarcated, and legally accessible. The Client must respond promptly to all necessary communication and approvals regarding design, material selection, and site access to prevent project delays.
4. Warranties and Limitation of Liability
A. Warranty
The Company provides warranties as detailed in the separate Refund and Rectification Policy and the Construction Agreement, including a standard 10-Year Structural Warranty and a 1-Year Workmanship Warranty.
B. Limitation of Liability
The Company’s total liability to the Client for any claim arising out of or relating to the Services, whether in contract or tort, shall not exceed the total contract price paid by the Client to the Company. We shall not be liable for any indirect, incidental, or consequential damages.
5. Governing Law and Dispute Resolution
These Terms and any dispute arising from the Services shall be governed by and construed in accordance with the laws of India, specifically within the jurisdiction of the courts located in Nagapattinam, Tamil Nadu. Any disputes shall first be attempted to be resolved through mutual negotiation or mediation before resorting to formal legal proceedings.
